How we help you

What does a trademark and patent lawyer do?

A trademark and patent attorney helps you protect your business's intangible assets: your name and logo, your inventions, and your designs. Their work begins before registration, with a search to determine if the mark or invention is available, and continues with the application to the Mexican Institute of Industrial Property (IMPI).

We also intervene when a conflict arises: in opposition, infringement, or annulment proceedings, and in the negotiation of license, assignment, or franchise agreements. At City Laws, we use clear language so you understand what you are protecting, for how long, and what obligations you are assuming.

Frequently asked questions

What clients ask most about Trademark and Patent Attorney

Where do I register a trademark in Mexico?+

Trademarks, patents, and other industrial property rights are processed through the IMPI (Mexican Institute of Industrial Property). Copyrights for works and software are registered with INDAUTOR (National Institute of Copyright), which is a separate process. We can advise you on which one applies to your situation.

How long does trademark registration last?+

In Mexico, trademarks are valid for ten years from the filing date and can be renewed indefinitely for equal periods. Furthermore, there is an obligation to declare their actual and effective use within the timeframes established by law. We help you keep track of these dates.

What is the difference between a trademark and a patent?+

A trademark protects the sign that distinguishes your products or services, such as a name or logo. A patent protects an invention with industrial application and is valid for a non-renewable period of twenty years from the date of application. Each type of protection has different requirements, and we'll explain which one you need.

What can I do if someone uses my trademark without permission?+

If your trademark is registered, the law provides for actions to defend it, such as an infringement procedure before the Mexican Institute of Industrial Property (IMPI). We review your situation and explain the options and steps to follow, without promising a specific outcome. The initial consultation is free.
