Is a notary lawyer the same as a notary public?+
No. A notary public is a professional authorized by the State who attests to and formalizes legal acts. A notary's attorney advises you, prepares and reviews documentation, and protects your interests before the notary, but does not replace the notary's role.
Can I buy a property without a public deed?+
For a property sale to be fully valid and registered in the Public Registry of Property, it must generally be formalized in a public deed before a notary. A private contract can serve as a preliminary agreement, but it does not provide the same security nor does it establish your ownership against third parties.
Do I need a power of attorney if I cannot be present?+
Yes. If you can't be there in person to sign, a power of attorney allows someone else to act on your behalf within the limits you define. We'll help you draft it with the appropriate scope to prevent it from being used beyond what you authorize.
As a foreigner, can I buy a property in the Riviera Maya?+
Yes. In the restricted zone, which includes the coastal strip of Quintana Roo, foreigners typically acquire property through a bank trust, with permission from the Ministry of Foreign Affairs and formalized before a notary. We review the process to ensure the transaction is properly structured.
