On the coast of Baja California Sur, the legal detail is everything.
Cabo San Lucas's legal services focus largely on real estate transactions for foreigners, estate planning, and residency procedures for those who choose to retire there. Because it lies within the 50-kilometer coastal zone, a foreigner cannot directly purchase residential property: the standard procedure is through a trust with a Mexican bank acting as trustee, in accordance with Article 27 of the Constitution and the Foreign Investment Law.
In addition, there's the condominium ownership system, very common in tourist developments, and the need to coordinate with a notary to formalize each transaction. Reviewing the property title, land use regulations, and maintenance fees before signing prevents surprises that can be costly to resolve later.

What clients ask most
Can a foreigner buy a house in Cabo San Lucas?+
Yes, although because it's within the 50-kilometer coastal zone, you can't acquire the residential property directly. The usual way is through a trust with a Mexican bank as trustee, which grants you the use, enjoyment, and disposal of the property. We review each case to advise you on the appropriate structure.
What is a real estate trust and how long does it last?+
This is a contract in which a Mexican bank acquires the property located in the restricted zone and manages it for the benefit of the foreign buyer, who retains the rights of use and disposal. It is established for a term of 50 years and is renewable. We explain the obligations and costs before you sign.
Do you help with residency so I can retire in Los Cabos?+
Yes. We assist with temporary and permanent residency applications with the INM (National Institute of Migration), including the financial solvency route often used by those retiring. We review requirements and processing times based on your specific situation, but we don't promise deadlines that are beyond our control.
Do they offer services in English and remotely?+
Yes. We offer bilingual service in Spanish and English and coordinate powers of attorney and signatures for clients residing outside of Mexico. Much of the process can be completed remotely, with in-person visits only when absolutely necessary.
